These Terms & Conditions apply to purchases made through Wilkinson Tennis Studio (“Wilkinson Tennis Studio,” “we,” “us” or “our”), whether made online, in person or by another authorized method. This includes simulator rentals, tennis lessons, private lessons, camps, clinics, memberships, programs, leagues, events and other products or services offered by Wilkinson Tennis Studio.
By completing a purchase, you agree to these Terms & Conditions.
Important Notice Regarding Cancellation Rights
Certain purchases may be subject to cancellation or refund rights under British Columbia law, including applicable fitness or personal services contracts.
Nothing in these Terms & Conditions is intended to limit or waive any cancellation, refund or other consumer right that cannot legally be waived.
Subject to those rights, the cancellation and refund policies below apply.
1. All Sales Are Final
Except where a cancellation or refund is required by applicable law, all sales are final.
Purchases are non-refundable once completed. This includes, but is not limited to, simulator rentals, lessons, private coaching, camps, clinics, memberships, programs, leagues, events and other services.
Refunds, credits or make-up sessions will not normally be provided because of:
personal scheduling conflicts; change of plans; travel; forgetting a booking; late arrival; non-attendance; failure to use a purchased booking, lesson or membership benefit; or dissatisfaction resulting from personal performance or progress.
Please review the program description, dates, times, participant requirements and other purchase information carefully before completing your order.
Purchases are also non-transferable unless Wilkinson Tennis Studio has expressly approved a transfer in writing.
Any statutory cancellation or refund rights available under applicable British Columbia law continue to apply.
2. Lessons, Programs and Camps
Participants are responsible for registering for a program appropriate to their age and playing level. Wilkinson Tennis Studio reserves the right to recommend or require that a participant move to a different program where we believe another level is more appropriate.
Lessons and programs begin and end at their scheduled times. Arriving late does not extend the scheduled lesson or booking.
Missed lessons, classes or program dates are not eligible for refunds, credits or make-up sessions except where required by law or expressly authorized by Wilkinson Tennis Studio.
Wilkinson Tennis Studio may substitute a coach or instructor where necessary.
If Wilkinson Tennis Studio cancels a lesson or program session, we may reschedule the session, provide an appropriate credit or provide a refund where required by applicable law.
3. Simulator and Facility Bookings
Simulator and facility reservations are for the specific date and time purchased.
Participants who arrive late may use only the remaining time in their reservation. A booking cannot normally be extended because of late arrival.
Players must follow all instructions provided by Wilkinson Tennis Studio staff and all posted simulator and facility safety rules.
Only equipment and activities permitted by Wilkinson Tennis Studio may be used within simulator areas. Players must maintain a safe distance from other participants, screens, ball-launching equipment and other facility equipment and must remain aware of loose tennis balls and other potential hazards.
Wilkinson Tennis Studio may stop a session where a participant is using equipment improperly or engaging in unsafe behaviour.
Simulator technology, sensors, software, displays and other electronic equipment may occasionally experience interruptions, calibration differences or technical issues. Wilkinson Tennis Studio does not guarantee that simulator statistics, measurements or results will be completely error-free.
4. Memberships and Passes
Memberships, passes and similar access privileges are issued to the person for whom they were purchased and may not be shared, transferred or resold unless expressly permitted by Wilkinson Tennis Studio.
Membership privileges, booking availability and included services depend on the membership purchased. Membership does not guarantee availability of a particular court, simulator, coach or booking time.
Any specific membership term, renewal provision or cancellation provision presented when the membership is purchased forms part of these Terms & Conditions.
Where applicable, statutory cancellation rights under British Columbia law will apply.
5. Waiver & Release of Liability
Participation in tennis, lessons, simulator activities and other physical activities at Wilkinson Tennis Studio involves inherent risks.
All participants must complete any required Waiver, Release of Liability and Assumption of Risk Agreement before participating.
The waiver may address matters including assumption of the risks associated with tennis and physical activity, interactions with tennis balls, racquets, other players and equipment, slips and falls, simulator and ball-launching equipment, physical exertion, personal injury, emergency assistance and other risks associated with participation.
Completing a purchase does not replace the requirement to complete the applicable waiver.
For participants under the age of majority, a parent or legal guardian must complete any required parent or guardian consent, acknowledgement or waiver documentation.
A participant who has not completed the required documentation may be refused participation. A refund will not be provided solely because a participant or parent/guardian declines to complete required participation documentation, except where a refund is required by law.
6. Participant Safety and Conduct
All participants and guests are expected to follow facility rules, posted notices and reasonable directions from Wilkinson Tennis Studio staff.
Participants must conduct themselves safely and respectfully and must not engage in behaviour that puts themselves, other participants, staff or property at risk.
Appropriate athletic clothing and footwear must be worn where required.
Participants must not participate while impaired by alcohol, recreational drugs or any other substance that may affect their ability to participate safely.
Parents and guardians remain responsible for children before and after their scheduled lesson, camp or program unless Wilkinson Tennis Studio has expressly assumed supervision during that time.
7. Refusal or Revocation of Access
Wilkinson Tennis Studio reserves the right to refuse or revoke access to the facility, lessons, simulators, programs or membership privileges where a person:
fails to follow safety instructions or facility rules; acts aggressively, abusively or disrespectfully toward staff or other guests; deliberately or repeatedly misuses equipment; creates a safety risk; allows another person to improperly use their membership or booking; or otherwise materially breaches these Terms & Conditions.
Where permitted by law, removal or suspension for a participant’s misconduct does not entitle the participant to a refund or credit.
8. Outside Coaching and Commercial Activity
Coaching, instruction, commercial training or other business activity may not be conducted at Wilkinson Tennis Studio without prior written authorization.
Customers may not resell bookings, memberships, lessons or other services, or use Wilkinson Tennis Studio facilities for unauthorized commercial purposes.
9. Changes to Facility Operations
Wilkinson Tennis Studio may adjust operating hours, lesson schedules, coaches, simulator availability, court availability or programming where reasonably necessary.
Temporary interruptions may occur because of maintenance, equipment failure, power or technology interruptions, severe weather, staffing issues, emergencies or other circumstances affecting safe or reasonable facility operation.
Where Wilkinson Tennis Studio must cancel a purchased service, we may reschedule the service, provide a credit or issue a refund where required by applicable law.
Temporary facility or equipment interruptions do not automatically create an entitlement to a refund, subject to any rights provided by applicable law.
10. Personal Property and Equipment
Participants are responsible for their personal belongings while at Wilkinson Tennis Studio.
Wilkinson Tennis Studio is not responsible for lost, stolen or damaged personal property except to the extent responsibility cannot legally be excluded.
Any equipment provided, loaned or rented by Wilkinson Tennis Studio must be used properly and returned in substantially the same condition in which it was provided, reasonable wear and tear excepted.
Participants may be responsible for the reasonable cost of repairing or replacing equipment or property damaged through misuse, deliberate conduct or failure to follow staff instructions, to the extent permitted by law.
11. Prices and Payment
All prices are stated in Canadian dollars unless otherwise indicated. Applicable taxes will be added where required.
Payment is charged at the time of purchase unless different payment terms are expressly stated.
If a product or service is accidentally listed with an incorrect price or material description, Wilkinson Tennis Studio reserves the right to correct the error. If payment has already been processed and Wilkinson Tennis Studio cannot honour the purchase as presented, the affected amount will be refunded.
12. Health and Ability to Participate
Participants are responsible for determining whether they are physically able to safely participate in tennis and related activities.
Participants should advise their coach or Wilkinson Tennis Studio staff of any relevant limitations that may affect safe participation.
Nothing provided by Wilkinson Tennis Studio, including simulator statistics, coaching feedback or training information, constitutes medical advice.
13. Governing Law
These Terms & Conditions are governed by the laws of the Province of British Columbia and the applicable laws of Canada.
Nothing in these Terms & Conditions limits any consumer protection or other legal right that cannot lawfully be waived.
